Patent Protection, Public Disclosure & Grace Period
To obtain valid patent protection the invention must be novel and inventive at the time the first patent application is filed. Therefore, it is important to rememeber
that you must not sell, offer to sell or publicly disclose details of your invention before filing a patent application. Such premature disclosure may risk
invalidating any protection subsequently obtained.
Under Australian patent law a grace period of 12 months from any public disclosure is provided in which to file a complete (full) application. However, such a broad grace
period is not provided in most other countries. Therefore patent rights to the technology at issue may be jeopardised in other jursidictions outside Australia should
premature disclosure occur. It is therefore recommended that before any public disclosure (and preferably before any confidential disclosure) of the details of an
invention occur, a provisional patent application be filed to secure your rights to the invention.
